I disagree with you about the judge’s choice, if the judge was virtually certain an acquittal would be the verdict. An acquittal is final. It cannot be appealed to another level of the court (so long as the constitution is followed, that is). If he had dismissed the charges, even with prejudice, a very determined prosecutor could attempt to reprosecute and punish the accused just by making them go through the effort and expense of defending themselves again. This way, it really can’t be done. Acquittals on all counts are final. (N.B. I am not a lawyer, however. I am a scientist. A true legal expert may be in a position to correct me, and I would appreciate it if anyone working in the legal field wants to do so.)
Took law in college. Yes. An Acquittal is final due to double jeopardy. Once found innocent in a jury trial, you cannot be re-tried for the same crime. Smart of the judge to do this, as he also could have vacated the jury ruling if they had come back guilty due to tampering. The prosecution utterly screwed the case. Isn’t it interesting to note:
1) According to the left, Kyle was a racist, even though ALL the people he shot were white, because those white people had gathered to “honor” a black police “victim” (who deserved everything he got from the police, but that’s another story).
2) Every one of the white people who “gathered to honor the black guy” and got shot (or shot at) was a felon or habitual criminal.
Clearly it’s true that who your friends are says who you are.
Rittenhouse’s attorney, Mark Richards, said his client “wishes none of this would have ever happened.”
I do hope the episode serves to dissuade the decisions made and actions taken by Kyle that night. He was/is a boy incapable of the kind of logic and reason and restraint that comes from maturity and experience. And his experience in spite of the correct verdict has ruined his life, much as G. Zimmerman’s was ruined.
You can’t fix stupid, but hopefully the stupidity of one can serve as schooling for others.
A few thoughts about this ongoing situation: Between Zimmerman and Rittenhouse the attitude of the nation has grown against those committing blatant crimes. On the other hand those engaged in this destruction have enjoyed fewer repercussions as time has passed. The politicians and bureaucrats haven’t allowed the police or the guard to do their jobs. The 17 year old wasn’t there to stop a riot, he was there to protect a relative or friend’s car lot. As the cars were set aflame Kyle retreated. He tripped and while getting up took a boot to the head from a 6’5″ professional criminal, who’s known by the police. No repercussions.
Kyle didn’t stop the riot, but he escaped it. Barely. His near sacrifice has, for over a year, given the country a chance to think more clearly about where we are headed as a nation. Attitudes are beginning to turn around. I think citizens have realized this can happen from the street level as well as the political. Guns. It always comes down to guns.
